Mary Mae Greenhouses is a trade name of Mary Mae LLC, a Pennsylvania limited liability company (“Mary Mae Greenhouses,” “Mary Mae,” “we,” “us,” or “our”).
By accessing our website, creating an account, placing an order, purchasing a product, or otherwise using our services, you agree to these Terms and any policies incorporated into them by reference.
If you do not agree to these Terms, please do not use our website or services.
1. ELIGIBILITY
By using our website or placing an order, you represent that you are legally capable of entering into a binding agreement or are using the website with the permission and supervision of a parent or legal guardian.
You may not use our website or services for any unlawful or unauthorized purpose.
2. PRODUCTS AND AVAILABILITY
Mary Mae Greenhouses sells live plants, plant-related products, pots, accessories, gifts, and other merchandise.
All products are subject to availability.
We reserve the right to:
• Limit quantities
• Discontinue products
• Change product assortments
• Restrict sales of certain products to certain locations
• Refuse or cancel orders when reasonably necessary
• Correct errors in product descriptions, inventory, availability, or pricing
Adding an item to a shopping cart does not reserve or guarantee its availability.
3. LIVE PLANTS ARE NATURALLY VARIABLE
Plants are living products and naturally vary.
Unless a product listing specifically states that you will receive the exact plant pictured, photographs are representative of the plant variety and general product offered.
The plant you receive may differ in:
• Height
• Width
• Leaf count
• Shape
• Coloration
• Variegation
• Growth habit
• Maturity
• Bloom status
• Branching
• Root development
• Other natural characteristics
Plant measurements and sizes listed on our website are approximate unless expressly stated otherwise.
Natural variation is not considered a product defect.
4. NATURAL IMPERFECTIONS AND SHIPPING STRESS
Live plants may experience some degree of stress during packaging and transportation.
Minor conditions such as:
• Temporary wilting
• Minor leaf loss
• Small tears or blemishes
• Slight discoloration
• Soil displacement
• Bent leaves
• Minor cosmetic damage
• Temporary changes in plant appearance
may occur during shipping and do not necessarily indicate that a plant is unhealthy or defective.
Claims involving plants that arrive dead or significantly damaged are governed by our Live Plant Guarantee and related policies.
5. PRODUCT PHOTOGRAPHS
We make reasonable efforts to accurately represent our products.
However, colors and appearance may vary because of photography, lighting, screen settings, plant maturity, growing conditions, seasonal changes, and natural variation.
Decorative pots, staging materials, accessories, furniture, or other objects appearing in product photographs are not included unless specifically identified as included in the product description.
6. PRICING
Prices are displayed in U.S. dollars unless otherwise stated.
Prices may change without notice.
We make reasonable efforts to provide accurate pricing, but errors may occasionally occur.
If a product is listed at an incorrect price because of a typographical, technical, system, supplier, or other error, we reserve the right to correct the error and cancel or modify the affected order as permitted by law.
If an order is canceled after payment because of our pricing error, the amount paid for the canceled item will be refunded.
7. ORDERS
Submitting an order does not necessarily constitute final acceptance of that order.
We reserve the right to refuse or cancel an order for legitimate business reasons, including:

• Pricing or listing errors
• Suspected fraud
• Payment problems
• Shipping restrictions
• Agricultural restrictions
• Incorrect customer information
• Technical errors

If we cancel a paid order, we will refund the applicable amount unless otherwise permitted by law.
8. PAYMENT
Payment is due when required during checkout.
Payments may be processed through third-party payment providers.
You represent that you are authorized to use the payment method submitted with your order and that the information you provide is accurate.
Applicable taxes, shipping charges, and other charges will be displayed or calculated as part of the checkout process when required.
9. ORDER CHANGES AND CANCELLATIONS
Because live plants and other products may be prepared for shipment shortly after an order is received, changes and cancellations cannot always be accommodated.
Contact us as soon as possible if you need to modify or cancel an order.
An order is not considered changed or canceled until Mary Mae Greenhouses confirms the change or cancellation.
Orders that have already been processed, packed, transferred to a carrier, or shipped may not be eligible for cancellation.
10. SHIPPING
Shipping times and delivery estimates are estimates and are not guarantees unless expressly stated otherwise.
Carrier delays and other circumstances outside our reasonable control may affect delivery.
Shipping is subject to our separate Shipping Policy, which is incorporated into these Terms by reference.
Customers are responsible for providing a complete and accurate shipping address.
Mary Mae Greenhouses is not responsible for delays, failed deliveries, losses, or damage resulting from incorrect or incomplete addresses provided by the customer, subject to applicable law.
11. WEATHER AND LIVE PLANT SHIPPING
Live plants are particularly sensitive to extreme temperatures.
We may delay shipment when we reasonably believe weather conditions could create an unacceptable risk to plant health.
This may include extreme:
• Heat
• Cold
• Storms
• Carrier disruptions
• Other dangerous shipping conditions
Weather holds may result in orders shipping later than originally estimated.
We would rather temporarily delay a live plant shipment than knowingly send a plant into dangerous conditions.
Additional terms regarding weather-related shipping are contained in our Shipping Policy and Live Plant Guarantee.
12. AGRICULTURAL RESTRICTIONS
Live plants are subject to federal, state, and local agricultural laws and regulations.
Some plants may not legally or responsibly be shipped to certain destinations.
Mary Mae Greenhouses reserves the right to restrict, modify, or cancel shipments based on agricultural requirements, quarantine restrictions, pest regulations, carrier limitations, or other applicable requirements.
Customers may not knowingly order products prohibited from entering their destination.
If an order cannot legally be fulfilled, we may cancel the affected product or order and issue an applicable refund.
13. DELIVERY AND PROMPT PACKAGE RETRIEVAL
Customers are responsible for monitoring tracking information and retrieving live plant shipments promptly after delivery.
Plants should not be left for extended periods in mailboxes, parcel lockers, delivery vehicles, porches, outdoor areas, or other locations exposed to extreme temperatures or unsuitable conditions.
Failure to retrieve a delivered live plant shipment within a reasonable period may affect eligibility under our Live Plant Guarantee.
14. LIVE PLANT GUARANTEE
Eligible live plant purchases are subject to our separate Live Plant Guarantee.
If a plant arrives dead or significantly damaged, customers must notify Mary Mae Greenhouses within the timeframe stated in that policy and provide the requested documentation.
Documentation may include photographs of:
• The plant
• Nursery pot
• Soil/root area when relevant
• Internal packaging
• Shipping box
• Shipping label or visible carrier damage
Claims submitted outside the applicable claim period may not qualify for coverage.
Our Live Plant Guarantee is incorporated into these Terms by reference.
15. RETURNS, REFUNDS AND EXCHANGES
Due to their living and perishable nature, live plants generally cannot be returned or exchanged.
Non-living merchandise may be eligible for return depending on the product and circumstances.
All returns, refunds, replacements, credits, and exchanges are subject to our separate Returns & Refunds Policy and, where applicable, our Live Plant Guarantee.
Nothing in these Terms limits rights that cannot legally be waived.
16. PLANT CARE
Plant care information provided by Mary Mae Greenhouses is intended as general educational guidance.
Successful plant care depends on numerous factors outside our control, including:
• Light
• Watering
• Temperature
• Humidity
• Soil
• Fertilization
• Repotting
• Pest exposure
• Local climate
• Household environment
• Customer care practices
We cannot guarantee the continued health, growth, flowering, appearance, or survival of a plant after delivery merely because care information was provided.
17. PLANT SAFETY AND TOXICITY
Information concerning plant toxicity, pet safety, and human safety is provided for general informational purposes only.
Such information is not veterinary, medical, poison-control, or other professional advice.
Plants described as “pet friendly,” “pet safe,” or similar are identified based on generally available plant-safety information. Such descriptions are not a guarantee that ingestion, contact, or exposure cannot cause irritation, illness, allergic reaction, digestive upset, choking, or another adverse response.
Individual animals and people may react differently.
Customers are responsible for determining whether plants are appropriate for their household and for keeping plants away from pets and children when appropriate.
If ingestion, poisoning, allergic reaction, or other concerning exposure is suspected, contact an appropriate veterinarian, physician, poison-control service, or emergency provider.
18. USER ACCOUNTS
Certain website features may allow you to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
You agree to provide accurate and current information.
Notify us promptly if you believe your account has been accessed without authorization.
19. REVIEWS AND USER-SUBMITTED CONTENT

Such circumstances may include severe weather, natural disasters, carrier disruptions, labor disruptions, government actions, agricultural quarantines, utility or internet outages, supply interruptions, emergencies, or similar events.
29. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Mary Mae LLC from claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of our website, your violation of these Terms, or your infringement of another person's rights.
This provision does not apply to the extent prohibited by applicable consumer law.
30. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in these Terms deprives a consumer of protections that cannot legally be waived.
31. SEVERABILITY

The remaining provisions will continue in effect.
